Bronx Medical Negligence Attorney

What happens when your medical professional fails to follow standards of care?

An increasingly complex healthcare system, new technology and tests – even confusing insurance rules – is all an invitation for cutting corners as doctors, nurses, pharmacists, anesthesiologists and other medical professionals struggle to meet demands. Nobody says their jobs are easy, but these professionals have also assumed a responsibility to uphold the highest standards of care and to above all do no harm.

At the Bronx law firm of James Newman, P.C., we believe that when medical negligence causes pain, leads to complications or infection, creates dire health conditions or, in the worst case, leads to death, the medical professional, hospital or clinic must be held responsible. We have helped thousands of individuals and their families who have suffered the consequences of medical negligence recover costs of medical and other expenses that they face now and in the future as they heal. If you have been harmed, we can evaluate your case and help you get the compensation you deserve.

What is medical negligence?

You may hear the terms medical malpractice and medical negligence used interchangeably. Medical negligence generally means that harm has been caused because the physician or other licensed medical practitioner, a hospital or healthcare facility failed to take an action that caused the patient harm. Negligence is frequently a component of a medical malpractice lawsuit.

Examples of negligence may include an unsafe delay in treating an emergency room patient or causing his or her condition to worsen drastically. In that case, the emergency room staff’s failure to act promptly caused harm. Another example could include a delay in performing a C-section, leading to a significant birth injury. In both examples, negligence caused injury. Additional examples of negligence we often find our clients have experienced include:

  • Hospital mistakes
  • Private doctor errors
  • Improper medication
  • Surgical complications
  • Failure to manage complications
  • Infections
  • Informed consent issues

When the healthcare professional or facility fails to meet an expected standard of care and the negligence or medical error is the cause of harm, there is a valid reason to file a lawsuit to recover damages, including compensation for:

  • Current and future medical expenses
  • Loss of wages
  • Loss of earning capacity
  • Pain and suffering
  • Loss of quality of life
