$6,000,000.00 – Obstetrical Malpractice / Birth Injury

Bronx County settlement for a baby that suffered severe brain damage and cerebral palsy as a result of a failure to timely diagnose and treat fetal distress.

$3,057,500.00 – Surgical Malpractice

Trial verdict in New York County Supreme Court for permanent nerve injuries sustained by then 35-year old maintenance worker permanently disabled as a result of a failed and negligently performed bilateral laparoscopic inguinal hernia surgery.

$3,000,000.00 – Labor Law/Construction Accident

This case, which settled during jury selection, involved our client, a 30-year old construction worker, who was severely injured as a result of a fall from a scaffold he was working on.  As a result of the scaffold collapsing our client was caused to suffer multiple leg and back fractures requiring numerous surgical procedures.

$1,691,385.00 – Medical Malpractice/Orthopedic Malpractice:

At trial in Brooklyn Supreme Court the jury returned a verdict of $1,691,368.00 on behalf of our client, a 41-year old maintenance worker, who was the victim of orthopedic malpractice following a botched total ACL (anterior cruciate ligament) surgery whereby our client developed post-operative deep vein thrombosis (DVT) and pulmonary embolism (PE) requiring prolonged hospitalization, which was followed by a horrific course of care including four subsequent surgeries aimed at revising our client’s knee.

$1,500,000.00 – Medical Malpractice/Obstetric Malpractice

This settlement before trial was for the wrongful death of a 40-year old woman who had recently undergone a total abdominal hysterectomy.  Due to a blatant error by the hospital and nursing staff of prematurely removing DVT prophylaxis boots our client was caused to develop a fatal pulmonary embolism, which sadly was entirely preventable.

$1,500,000.00 – Medical Malpractice

This case involved the improper administration of sclerotherapy for the treatment of varicose veins.  The vascular surgeon who performed the procedure failed to diagnose peripheral arterial disease in the patient’s lower limb, which resulted in ischemia, gangrene, the loss of several toes and a large open wound of the foot requiring years of wound therapy.

$1,400,000.00 – Psychiatric Malpractice – Negligent Administration of Anti-Psychotic Medication

During mediation under the Federal Tort Claims Act we were able to reach a settlement for the negligent prescription by an inexperienced psychiatrist of a powerful anti-psychotic medication, Perphenazine, which caused profound and permanently debilitating injury to our wonderful client in the form of tardive dyskenesia, a neurological disorder causing involuntary movements and muscle spasm of the face, neck and muscles of respiration.

$1,000,000.00 – Motorcycle Accident

Settlement on behalf of motorcyclist who was ejected from his motorcycle due to a failure to properly mill and pave a major Bronx roadway during reconstruction.

$950,000.00 – Trip & Fall 

During trial this case settled for our client, a young woman working as a Federal corrections officer, who shattered her elbow as a result of a trip and fall over broken and uneven concrete within the Chambers Street subway station in downtown Manhattan.

$930,000.00 – Motor Vehicle Accident

Trial verdict in Bronx Supreme Court on behalf of a passenger in a taxi that was struck by a motorist making an illegal left turn from 7th Avenue in midtown Manhattan.  The plaintiff, a 39-year old hair stylist, suffered a labral tear of her right hip requiring two surgeries.

$750,000.00 – Motor Vehicle Accident/Pedestrian Knockdown

In this case our client, a home health aide from Ghana, was crossing the street when the defendant, who was texting and driving, lost control of her vehicle impacting the plaintiff at high speed.  Miraculously, our client lived through the ordeal, however she was caused to suffer extensive injuries including fractures of her foot, arm, clavicle and hip, as well as trauma to her head and torso.

$750,000.00 – Medical Malpractice/General Surgery Negligence

During a ventral hernia repair surgery our client’s colon was caused to be punctured by the general surgeon performing the procedure.  Due to an inadequate repair of the hernia our client went through a truly horrific post-operative course including the development of a colocutaneous fistula, over a month long hospitalization and the need for multiple additional surgeries.

$510,350.00 – Labor Law/Scaffold Collapse

At trial in Bronx Supreme Court the jury returned a verdict of $510,350.00 on behalf of our client, a 59-year old construction worker who was caused to suffer two fractured bones in his foot when the scaffold upon which he was painting suddenly collapsed out from under him.  Due to the nature of his injuries he was unable to have surgery performed, however his injuries left him with a permanent disability.

$450,000.00 – Intentional Tort/Assault & Battery

Our client, a door man for a luxury Manhattan apartment building, was viciously beaten and repeatedly kicked on the ground by an intoxicated tenant on Christmas Eve, which caused multiple fractured bones of his knee, thigh and right leg necessitating major skin grafting procedures due to the extent of the damage.

$365,000.00 – Medical Malpractice/Hospital Negligence

Following the completion of a lengthy trial, and while the jury was out deliberating, a settlement of $365,000.00 was reached for the wrongful death of our client, an 89-year old man who was admitted to the hospital with a mild lung infection, which was improperly treated.  Due to the hospital staff’s negligence what was initially a relatively minor infection was caused to develop  full blown bilateral pulmonary edema and pleural effusions, or a collection of fluid around the lungs, and despite a lengthy battle by our client resulted in his wrongful death.

$250,000.00 – Premises Liability/Defective Automatic Door

In this case our client, a 65-year old woman, was in the process of retrieving her shopping cart with the defendant’s grocery store when a defective automatic entryway door was caused to swing forward.  As a result of the door striking our client she was caused to fall to the floor suffering an extremely painful and debilitating fracture of her pelvis.

$225,000.00 – Motor Vehicle Accident

Our client, a 46-year-old man, was involved in a rear end collision in Manhattan. The client suffered serious injuries to his neck, back and chest.

$100,000.00 – Motor Vehicle Accident

This case involved our client who sustained knee injuries following a rear-end motor vehicle accident.  During this, his first trial of his career, Kyle Newman was able to secure a $100,000.00 verdict for our client, who was caused to undergo knee arthroscopic surgery and miss approximately six months from work.
